Acie Lumumba, whose real name is William Mutumanje, is taking his case to the Constitutional Court after Harare magistrate Vakayi Chikwekwe yesterday ruled that he should stand trial on Friday.
Lumumba who is facing charges of undermining the authority of the President, after shouting a four-letter word insult at the President, had sought the dismissal of his case arguing that the court could not proceed with his case because the State did not have the Prosecutor-General’s permission to prosecute him.
“Your Worship, Section 34 of the Criminal Law (Codification and Reform) Act is clear that an accused person who is being charged for undermining the authority of the President, the authority of the Attorney-General, now the Prosecutor-General, must be sought,” he argued.
But the State argued that the law allowed the Prosecutor-General to delegate his powers.
Lumumba’s lawyer Arshiel Mugiya said he was taking the case to the Constitutional Court because there were constitutional issues which needed to be determined by the highest court.
