Tshabangu says that Sikhala was tasked with going to the Zimbabwe Electoral Commission to lodge the MDC-A constitution as the CCC constitution on 24 January when nominations for the by-elections opened but he was called by Chamisa to come back before submitting the constitution.
CCC was officially formed on 24 January, the very day nominations opened.
Tshabangu said Sikhala therefore ought to have the register of who attended the meeting to form CCC as well as the minutes but he said he could not access them as Sikhala was in jail.
Tshabangu said to prove that nothing had changed, CCC continued to call Tendai Biti and Welshman Ncube, vice-presidents well into February 2022 as they campaigned for the 26 March by-elections.
Chalton Hwende was also referred to as the secretary general.
Tshabangu said CCC also continued to use the MDC twitter handle established in 2010 to this day.
He said it was mischievous for the CCC to sue him personally for recalling Members of Parliament, Senators and Councillors because the recalling of legislators could only be done by a political party and not by an individual.
Judgement in the case was reserved.
Chamisa has refused to acknowledge whether Sikhala is a member of CCC or not. When asked by one of his X followers whether Sikhala was a member of the movement or not, Chamisa responded: “Job is a Zimbabwean. He deserves freedom. His case is our cause and collective fight!!”
There have been whispers that Chamisa entered into a pact with President Emmerson Mnangagwa to throw the elections but he insisted that one of the conditions was that Sikhala must not be released from prison.
