M&G Zimbabwe 2002 election report case sent back to High Court

The South African court case in which the Mail and Guardian newspaper which is owned by Zimbabwean publisher Trevor Ncube was requesting the release of a report by two South African judges on the 2002 presidential elections in Zimbabwe was referred back to the High Court by the country’s highest court, the Constitutional Court.

The Mail and Guardian had won the case forcing the government to release the report both at the High Court and at the Supreme Court of Appeal but the South African government insisted it could not release the report because this would disclose information supplied in confidence by another State.

The Mail and Guardian wants the report released under the Promotion of Access to Information Act.

The Constitutional Court referred the case back to the High Court in Pretoria to examine the record to determine whether it can be released or not.
